These Terms of Service (the “Terms”) govern your use of the North Shore BBQ website (the “Site”) operated by North Shore BBQ LLC. By using the Site, you agree to be bound by these Terms. If you do not agree, please stop using the Site.
Use of the Site
You agree to use the Site only for lawful purposes and only in ways that do not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of it. You agree not to:
- Submit knowingly false information through any of our forms.
- Attempt to gain unauthorized access to any part of the Site, our servers, or any related systems or networks.
- Use the Site to send spam, scrape data at scale, or run any automated activity that places undue load on our infrastructure.
- Interfere with security-related features (CAPTCHA, rate limiting) or attempt to bypass them.
Reservations and orders
Reservations submitted through the Site are requests and are not confirmed until we contact you by phone or email. We reserve the right to decline or modify any reservation request. Online orders, where available, are subject to item availability and our acceptance — we may cancel and refund orders that we cannot fulfill.
Pricing displayed on the Site is current at the time of display but may change without notice. We reserve the right to correct pricing errors before completing an order.
Job applications
Submitting an application through the careers section does not create any employment relationship or obligation. We review every application but cannot respond individually to all of them.
Intellectual property
The Site, including its text, photos, menus, branding, and code, is owned by North Shore BBQ LLC or licensed to us, and is protected by copyright and trademark laws. You may not reproduce, distribute, publicly display, or create derivative works from any of it without our prior written consent, except for personal, non-commercial use.
No warranty
The Site is provided on an “as is” and “as available” basis. We do not guarantee that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the fullest extent permitted by law, North Shore BBQ LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of (or inability to use) the Site.
Indemnification
You agree to indemnify and hold harmless North Shore BBQ LLC from any claims, damages, losses, liabilities, costs, and expenses arising out of your use of the Site or your violation of these Terms.
Governing law and disputes
These Terms are governed by the laws of Hawaii, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Hawaii, and you consent to personal jurisdiction in those courts.
Changes
We may revise these Terms from time to time. The effective date at the top of this page reflects the latest version. Your continued use of the Site after revisions become effective constitutes acceptance of the new Terms.
